Bonnell 805 RX e-Moto Limited WarrantyUpdated 2 months ago
1. Overview
Bonnell Electric Limited ("Bonnell", "we", "our" or "us") warrants the Bonnell 805 RX e-Moto ("Vehicle") against defects in materials and workmanship, subject to the terms and exclusions set out in this Limited Warranty.
The 805 RX is a high-performance electric off-road motorcycle designed for off-road riding. High-performance use does not make the Vehicle indestructible. Proper operation, inspection, maintenance and servicing in accordance with the Owner's Manual are essential to its safe operation and durability.
This Limited Warranty applies only to Vehicles purchased through Bonnell or an Authorized Bonnell Retailer or Dealer.
This Limited Warranty is in addition to any statutory rights or remedies that cannot legally be excluded or limited under the laws applicable in the jurisdiction where the Vehicle was sold.
2. Warranty Period
Unless otherwise required by applicable law, the following warranty periods apply from the date the Vehicle is delivered to the original purchaser.
Chassis — 24 Months
The chassis components of the Bonnell 805 RX are warranted against defects in materials and workmanship for 24 months.
Chassis components include, but are not limited to:
frame;
swingarm;
suspension components;
steering components;
hubs and wheel assemblies;
brake system components, excluding normal wear items;
drivetrain components, excluding normal wear items; and
other original mechanical components supplied by Bonnell.
Normal wear, routine adjustments, servicing and consumable components are not covered, except where a failure is caused by a defect in materials or workmanship.
Electronic Components — 12 Months
All electronic and electrical components are warranted against defects in materials and workmanship for 12 months.
Electronic components include, but are not limited to:
battery pack;
electric motor;
motor controller;
vehicle control units;
display and instrumentation;
wiring harnesses;
sensors;
switches;
charging system;
onboard electrical components; and
other original electronic components supplied by Bonnell.
Battery Capacity
The battery forms part of the Vehicle's electronic system and is covered by the 12-month electronic component warranty.
Normal reduction in battery capacity resulting from use, charging cycles, storage conditions and ageing is considered normal wear and is not a defect.
A battery may qualify for warranty consideration where its measured usable capacity decreases below 70% of its original nominal capacity within the 12-month warranty period, provided the battery has been operated, charged, maintained and stored in accordance with the Owner's Manual.
Battery condition and capacity will be assessed using Bonnell-approved diagnostic procedures.
Replacement Parts
Repair or replacement of a component under this Limited Warranty does not restart or extend the original warranty period, except where required by applicable law.
Replacement components may be new, refurbished, reconditioned or remanufactured, provided they are suitable for the Vehicle and provide substantially equivalent function and performance.
3. What This Warranty Covers
This Limited Warranty covers defects in materials or workmanship that arise during normal and intended operation of the Vehicle and during the applicable warranty period.
Subject to this Limited Warranty, Bonnell may, at its discretion and where permitted by law:
repair the defective component;
replace the defective component;
replace it with a substantially equivalent component then available; or
provide another remedy required by applicable consumer law.
All warranty diagnosis and repair must be carried out by Bonnell, an Authorized Bonnell Retailer or Dealer, or another repairer specifically approved by Bonnell.
Bonnell must authorize warranty work before repairs are performed. Unauthorized repairs may void your warranty and costs will not be reimbursed unless required by applicable law.
Parts removed and replaced under an approved warranty claim may become the property of Bonnell.
4. Intended Use
The 805 RX is designed for off-road motorcycle use when operated within the limitations, instructions and maintenance requirements specified in the Owner's Manual.
Normal intended use may include demanding terrain, jumps, acceleration, technical riding and other off-road conditions for which the Vehicle has been designed.
The existence of demanding riding conditions alone does not constitute misuse or abuse. Warranty coverage will depend on whether the claimed failure resulted from a defect in materials or workmanship or from an excluded cause described in this Limited Warranty.
Use of the Vehicle outside its intended operating limits, or continued operation after the Vehicle has become damaged or unsafe, may result in denial of a warranty claim.
5. Owner Responsibilities
The owner is responsible for properly operating, inspecting, maintaining and storing the Vehicle in accordance with the Owner's Manual and any service information provided by Bonnell.
The owner is responsible for:
completing required inspections and maintenance at the specified intervals;
maintaining correct chain adjustment and lubrication;
maintaining brakes, tires, bearings, suspension and other service items;
following battery charging, use and storage instructions;
addressing warning messages, abnormal noises, damage or other indications of a potential fault promptly;
stopping use of the Vehicle where continued operation could cause additional damage or create a safety risk; and
retaining reasonable evidence of maintenance and servicing.
For a warranty claim, Bonnell may request maintenance records, service invoices, receipts for parts or consumables, diagnostic information or other reasonable evidence that required maintenance has been completed.
Failure to perform required maintenance does not automatically void the entire Vehicle warranty. However, warranty coverage may be denied where Bonnell reasonably determines that the claimed failure was caused or materially contributed to by improper or insufficient maintenance.
6. What This Warranty Does Not Cover
This Limited Warranty does not cover damage, deterioration or failure resulting from:
Normal Wear and Maintenance
Normal wear, ageing, adjustment and routine maintenance, including but not limited to:
tires and tubes;
brake pads and brake discs where worn through normal use;
drive chains, sprockets and chain guides;
bearings and seals subject to normal wear;
grips, seats, plastics and contact surfaces;
suspension seals, bushings and service fluids;
brake fluid;
bulbs, switches, levers and similar consumable items;
fasteners requiring routine inspection or adjustment; and
normal reduction in battery capacity within the limits stated in Section 2.
Accident, Impact or External Damage
Damage resulting from:
crashes or collisions;
impact with rocks, trees, other vehicles or objects;
overturning;
incorrect transportation or securing of the Vehicle;
vandalism;
fire or other external heat sources;
flooding or water submersion beyond the Vehicle's specified operating limits;
natural disasters; or
other external causes unrelated to a manufacturing defect.
Misuse or Neglect
Damage caused by:
misuse, abuse, neglect or careless operation, including but not limited to, revving the bike while on the stand, powering off while the bike is in motion or coasting and turning the key switch off while the bike is in motion or coasting.
use contrary to the Owner's Manual;
overloading the Vehicle;
operating the Vehicle with known damage or a known fault where continued operation causes additional damage;
improper storage;
improper charging or use of an incompatible charger;
use outside specified environmental, temperature or operating limits; or
failure to perform required inspection, maintenance or servicing.
Unauthorized Modifications
Damage or failure caused by modification or alteration of the Vehicle outside configurations approved by Bonnell, including:
unauthorized opening of casing or changes to the motor, controller or battery;
modification of power, speed or safety limits outside Bonnell-approved settings;
unauthorized firmware or software modification;
non-approved battery packs, chargers or electrical components;
modification of the frame or structural components; or
installation of parts or accessories that cause or contribute to the claimed failure.
Installation of a non-Bonnell accessory does not by itself void the entire Vehicle warranty. However, damage caused or contributed to by that accessory or its installation is not covered.
Unauthorized Repairs
Damage caused by repairs, servicing or modifications performed contrary to Bonnell instructions or by unauthorized parties where those repairs or modifications caused or contributed to the claimed failure.
Cosmetic and Environmental Damage
This warranty does not cover normal cosmetic deterioration, including:
scratches, chips or dents;
fading;
surface corrosion;
discoloration;
damage to paint, coatings, decals or graphics;
damage caused by stones, road or trail debris, salt, chemicals or industrial contamination; or
damage caused by unsuitable cleaning products or cleaning methods.
7. Competition, Rental and Commercial Use
Unless Bonnell expressly provides otherwise in writing for a particular program, Vehicle or event, this Limited Warranty does not cover failures caused by:
professional or officially sanctioned competition use;
timed racing where the Vehicle is used outside its intended operating or maintenance parameters;
rental or fleet operation;
rider-training fleet use; or
other commercial use.
Participation in an event or use on a closed course does not, by itself, establish that a failure is excluded from warranty. Bonnell will assess whether the type of use caused or materially contributed to the claimed failure.
Bonnell may offer separate racing, competition, demonstration, fleet or commercial warranty programs with different terms.
8. Warranty Registration
Owners should register their Bonnell 805 RX within 7 days of delivery through the Bonnell Warranty Registration process.
Failure to register the Vehicle does not remove any rights that cannot legally be made conditional on registration. However, registration helps Bonnell confirm ownership, Vehicle identification and warranty information and may speed up support and warranty processing.
The Vehicle Identification Number (VIN) or other Vehicle identification information may be required when registering the Vehicle.
9. Making a Warranty Claim
If you believe your 805 RX has a defect covered by this Limited Warranty, notify Bonnell or an Authorized Bonnell Retailer or Dealer as soon as reasonably possible and, where applicable, within 10 days of discovering the issue.
A warranty claim should include:
owner's full name and contact details;
Vehicle model;
VIN or other Vehicle identification number;
date of purchase and/or delivery;
proof of purchase;
current operating hours and/or odometer reading, where available;
a clear description of the problem;
photographs or video showing the issue where appropriate;
relevant error codes or diagnostic information; and
maintenance or service records if requested.
Warranty claims may be submitted through Bonnell Customer Support, through an Authorized Bonnell Retailer or Dealer.
Bonnell may request additional photographs, videos, diagnostic information or documentation before authorizing a repair.
Where physical inspection is required, Bonnell will provide instructions regarding where and how the Vehicle or affected component should be inspected.
Do not ship a complete Vehicle, high-voltage battery or other hazardous-goods component to Bonnell without prior written instructions and authorization.
10. Warranty Repairs and Costs
For an approved warranty claim, Bonnell will cover the cost of parts required to perform the authorized warranty repair.
Labor performed by an Authorized Bonnell Retailer or Dealer is covered only where the work has been approved by Bonnell in advance and performed in accordance with Bonnell's warranty procedures and authorized labor allowance.
Unless required by applicable law or expressly approved by Bonnell in writing, this Limited Warranty does not cover:
towing;
roadside assistance;
Vehicle collection or delivery;
freight or transportation;
travel or accommodation;
loss of use;
rental or substitute vehicles;
loss of income;
competition entry fees; or
other incidental costs associated with a warranty claim.
11. Warranty Determination
Bonnell will evaluate each warranty claim based on the circumstances of the reported failure, Vehicle condition, diagnostic information, maintenance history and other relevant evidence.
Where permitted by applicable law, Bonnell will determine whether a claimed condition is the result of a defect covered by this Limited Warranty and whether repair or replacement is the appropriate remedy.
Nothing in this section limits any right or remedy that cannot legally be excluded under applicable consumer law.
12. Limitation of Liability and Responsibility for Use
The Bonnell 805 RX is a high-performance off-road motorcycle. Operating a motorcycle involves inherent risks, including the risk of accident, collision, loss of control, serious personal injury, death and damage to property. The owner and rider are responsible for operating the Vehicle safely, responsibly and in accordance with the Owner's Manual, all safety instructions, applicable laws and the intended use of the Vehicle.
12.1 Owner and Rider Responsibility
The owner and rider are responsible for:
determining whether the Vehicle is safe to operate before each use;
operating the Vehicle within their own ability and experience;
wearing appropriate protective equipment;
complying with applicable laws, regulations and riding restrictions;
ensuring that the Vehicle is properly maintained and serviced;
stopping operation of the Vehicle where damage, abnormal operation, warning messages or other conditions indicate that continued use may be unsafe;
the safe charging, transportation and storage of the Vehicle and battery; and
the manner in which the Vehicle is operated and any consequences arising from the owner's or rider's acts or omissions.
To the fullest extent permitted by applicable law, Bonnell is not responsible for injury, death, loss or property damage resulting from the owner's, rider's or any third party's operation, handling, transportation, charging, storage or use of the Vehicle.
12.2 Accidents, Misuse and Other Causes Outside Bonnell's Control
To the fullest extent permitted by applicable law, Bonnell shall not be liable for death, personal injury, loss, damage or expense arising from or relating to:
rider error or loss of control;
accident, crash, collision or impact;
misuse, abuse, neglect or careless operation;
operation outside the intended use or specified operating limits of the Vehicle;
use of the Vehicle by an inexperienced, unqualified or otherwise unsuitable rider;
failure to follow the Owner's Manual, warnings, safety information or other instructions supplied by Bonnell;
failure to inspect, maintain or service the Vehicle as required;
continued operation after a fault, warning, damage or unsafe condition becomes apparent;
unauthorized modification, alteration or tuning of the Vehicle;
installation or use of non-approved components, batteries, chargers, accessories, software or firmware where they cause or contribute to the loss or damage;
unauthorized repairs or servicing where they cause or contribute to the loss or damage;
improper charging, storage or transportation;
use of the Vehicle by another person;
the acts or omissions of another rider, road or trail user, vehicle operator, spectator or other third party;
environmental conditions, terrain, obstacles or hazards; or
any other event or circumstance not caused by a defect in the Vehicle for which Bonnell is legally responsible.
12.3 Damage to Property
To the fullest extent permitted by applicable law, Bonnell shall not be responsible for loss of or damage to property arising from the operation, possession, transportation, charging, storage or use of the Vehicle where such loss or damage is not caused by a defect in the Vehicle for which Bonnell is legally responsible.
This includes, without limitation, damage to:
other vehicles or motorcycles;
buildings, garages or other structures;
roads, tracks, trails or land;
personal possessions;
charging equipment;
transportation equipment or trailers; and
property belonging to the owner, rider or any third party.
The owner and rider remain responsible for any loss, damage or third-party claim arising from their operation or use of the Vehicle to the extent that the loss, damage or claim results from their acts or omissions rather than from a defect for which Bonnell is legally responsible.
12.4 Indirect and Consequential Loss
To the fullest extent permitted by applicable law, Bonnell shall not be liable under this Limited Warranty for indirect, incidental, special, exemplary or consequential losses arising from the Vehicle or a warranty claim, including, where legally permitted:
loss of use of the Vehicle;
loss of income, profits, revenue or business;
loss of opportunity;
loss of enjoyment;
competition or event entry fees;
travel or accommodation expenses;
towing or recovery costs;
rental or substitute vehicle costs; or
other economic losses not directly resulting from a defect covered by this Limited Warranty.
This exclusion applies only to the extent that such losses may lawfully be excluded.
12.5 Maximum Liability Under This Limited Warranty
To the fullest extent permitted by applicable law, Bonnell's total liability under this Limited Warranty shall not exceed the original purchase price paid for the Vehicle.
This limitation applies only to liability that may lawfully be limited and does not apply to any liability that applicable law prohibits Bonnell from excluding or limiting.
12.6 Manufacturing Defects and Bonnell Responsibility
Nothing in this Limited Warranty is intended to exclude Bonnell's responsibility where applicable law provides the customer with rights or remedies in relation to defective products, consumer guarantees, product liability, personal injury or property damage, those rights and remedies remain unaffected to the extent they cannot lawfully be excluded or limited.
12.7 No Additional Warranty Obligations
This Limited Warranty is Bonnell's express written warranty for the Vehicle.
No dealer, retailer, distributor, employee, representative or other person is authorized to modify this Limited Warranty or create any additional warranty, representation or liability on behalf of Bonnell unless expressly authorized by Bonnell in writing.
Any statement or representation made by another person shall not modify Bonnell's obligations under this Limited Warranty except where applicable law provides otherwise.
12.8 Mandatory Legal Rights
Some countries, states, provinces and territories do not permit certain exclusions or limitations of liability, damages or consumer rights.
Accordingly, the exclusions and limitations in this Section 12 apply only to the fullest extent permitted by applicable law.
Nothing in this Limited Warranty excludes, restricts or modifies any statutory guarantee, warranty, condition, right, remedy or liability that cannot lawfully be excluded, restricted or modified.
If any provision of this Section 12 is determined to be invalid, unlawful or unenforceable in a particular jurisdiction, that provision shall be applied to the maximum extent permitted by law and the remaining provisions shall remain in full force and effect.
13. Statutory Consumer Rights
This Limited Warranty provides contractual warranty rights in addition to any rights or remedies available to you under applicable consumer protection, product liability or other mandatory laws.
Nothing in this Limited Warranty is intended to exclude, restrict or modify any statutory guarantee, warranty, condition, right, remedy or liability that cannot lawfully be excluded, restricted or modified.
Where applicable law provides greater rights or remedies than those stated in this Limited Warranty, those statutory rights and remedies will apply.
Your rights may vary depending on the country, state, province or territory in which the Vehicle was purchased or supplied.
14. Governing Terms
This Limited Warranty should be read together with the Bonnell Terms and Conditions applicable to the purchase of the Vehicle and the 805 RX Owner's Manual.
If a provision of this Limited Warranty is determined to be invalid or unenforceable, the remaining provisions will continue in full force to the maximum extent permitted by applicable law.
